Terms of Service

These Terms of Service ("Terms") govern your access to and use of Proven Listing Systems (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Proven Listing Systems is AI-assisted software that generates real estate listing-marketing assets — including MLS descriptions, social captions, reel scripts, flyers, and property pages — from information you provide. The Service is offered on a free tier and on paid subscription plans.

2. Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. You must be a real estate professional (or otherwise authorized to market the properties you submit) and at least 18 years old.

3. Subscriptions, Billing & Cancellation

• Paid plans (e.g., Solo at $49/month and Producer at $149/month) are billed on a recurring monthly basis through our third-party payment processor until cancelled.
• Plans include a defined number of kits per billing period as described at checkout; the free tier includes one kit per month.
• You can cancel anytime; cancellation stops future renewals. Access continues until the end of the current paid period.
• Except where required by law, payments are non-refundable for partial billing periods.
• We may change pricing with advance notice; changes apply to subsequent billing periods.

4. Your Content & Responsibilities

You retain ownership of the property information, photos, and brand assets you upload ("Your Content"). You grant us a limited license to process Your Content solely to provide the Service. You represent that you have the rights to submit Your Content and that its use does not infringe others' rights.

You are responsible for reviewing every generated asset before publication and for verifying all property facts — price, square footage, room counts, taxes, HOA details, school references, zoning, and condition claims — and for compliance with MLS rules, fair-housing law, advertising regulations, and your brokerage's policies.

5. AI-Assisted Output

Outputs are generated by AI and may contain errors, omissions, or inaccuracies. They are provided for your review and editing, not as final, verified, or compliant copy. The Service does not provide legal, financial, valuation, appraisal, or brokerage advice and does not replace professional or regulatory review.

6. Acceptable Use

You agree not to use the Service to create unlawful, infringing, deceptive, discriminatory, or harmful content; to misrepresent properties; to reverse engineer or disrupt the Service; or to violate any applicable law or third-party right.

7. Intellectual Property

We own the Service, software, and our branding. Subject to these Terms, you own the marketing assets you generate from Your Content and may use them for your real estate business.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that output will be accurate, complete, or compliant.

9. Limitation of Liability

To the maximum extent permitted by law, Proven Listing Systems will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three (3) months before the claim arose.

10. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate access for violation of these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.

11. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Venue for any dispute lies in the state or federal courts located in Washington.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
